TERMS OF SERVICE:
"THERE ARE NO EXPRESS OR IMPLIED WARRANTIES FOR THE WEATHERWARN SERVICE, OR
THE SERVICES PROVIDED HEREUNDER. INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE WARRANTIES AND REMEDIES SET
FORTH IN THIS AGREEMENT ARE EXCLUSIVE AND IN LIEU OF ALL OTHERS WHETHER ORAL OR WRITTEN,
EXPRESS OR IMPLIED."
ItWorks dba WeatherWarn will not be liable for any failure or delay in performance due in whole or in part to any cause beyond ItWorks' reasonable control. In no event shall ItWorks be liable for any special, indirect, incidental or consequential damages; NOR SHALL ItWorks dba WeatherWarn BE LIABLE TO SUBSCRIBER FOR any damages WHETHER BASED ON CONTRACT, TORT OR ANY OTHER LEGAL THEORY beyond a refund of subscriber fees. This Agreement shall be governed by and interpreted, construed and enforced in accordance with the laws of the State of California."
CREATING AN ACCOUNT, LISTSERVICE, SUBSCRIPTION OR IN ANY WAY USING THE SERVICES
PROVIDED CONSTITUTES AN AFFIRMATION OF HAVING READ THE TERMS OF SERVICE AND THE SERVICE
DISCLAIMER, AND FULL CONSENT AND AGREEMENT THERETO.
